Participation Agreements
Without signed a Participation Agreement, the process of terminating a marriage is not Collaborative; without the protection of these enforceable contracts, the threat of litigation is ever-present and the promise of confidentiality is at risk. The contracts reference the goals of the parties, identify the process, define the professionals’ roles and set forth the codes of conduct by which the participants will be guided during the process. The Agreements state the procedure for termination of the process and identify the process for transition to litigation if necessary. Every Collaborative case should begin with a review of the pertinent Participation Agreement(s) and a full explanation of its implications.
